Terms & Conditions
1. Introduction
This agreement governs your use of baqbenchers.in and Baqbenchers services. By accessing or using our website or services, you agree to be bound by these Terms.
2. Definitions
Client: Any individual or entity contracting or interacting with Baqbenchers for services.
Services: All web, app, design, marketing, and consulting engagements offered by Baqbenchers.
3. Scope of Services
We provide IT and digital development services based on mutually agreed quotations or Statements of Work (SOW). Delivery, timelines, milestones, and completion criteria are governed by the specific project agreement.
4. Client Obligations
Clients must provide accurate requirements, access to necessary data, and timely feedback. Any delays caused by the client may impact project timelines and are not the liability of Baqbenchers.
5. Fees & Payment
Payments are due as per the agreed schedule outlined in project proposals. Unless otherwise agreed:
- 50% upfront payment to initiate work
- Remaining balance payable per milestone or delivery
Late payments may attract applicable interest charges.
6. Intellectual Property
Upon full payment, ownership of project-specific intellectual property transfers to the client. Pre-existing tools, frameworks, or reusable code remain the property of Baqbenchers unless explicitly stated otherwise in the agreement.
7. Confidentiality
Both parties agree to maintain confidentiality of sensitive information. Client data will not be disclosed except where legally required.
8. Warranties & Disclaimers
Services are provided “as is” and subject to client acceptance criteria. We do not guarantee outcomes such as revenue growth, traffic, or rankings unless explicitly stated in writing.
9. Limitation of Liability
Baqbenchers’ maximum liability is limited to the total fees paid by the client. We are not liable for indirect, incidental, or consequential damages.
10. Governing Law & Jurisdiction
These Terms are governed by Indian law. All disputes shall be subject to the exclusive jurisdiction of the courts of Lucknow, India.
11. Termination
Either party may terminate the engagement with 15 days written notice. Fees for work completed up to the termination date shall remain payable.
12. Changes to Terms
Baqbenchers reserves the right to update these Terms. Revised versions will be published on the website with updated effective dates.
